Terms for the Buyer
By purchasing Artwork through MeMyArt, you are agreeing to the terms set out below and to our Terms of Service both of which are incorporated into the Contract between you and MeMyArt.
When you buy artwork you will be directed to a secure payment site where you will be able to pay via your Paypal account, a credit or debit card.
The amount you will be asked to pay represents the full cost of the artwork including MeMyArt’s commission and postage and packaging.
You will receive an email confirming your purchase.
If you are not 100% happy with your purchase, you must contact Sales@MeMyArt.com within 14 days of delivery and we will either arrange for you to return the Artwork free of charge or resolve any questions that you have.
The full amount that you pay will be held by MeMyArt Ltd for the 14 days following delivery or, if you have contacted us in that time, until the Artwork is returned or your questions are resolved.
If we have not heard from you within 14 days of delivery we will release the funds to the Seller and you will no longer have any right to return the Artwork or to receive a refund.
When you buy Artwork, we will inform the Artist who will then have 4 days to confirm that the Artwork is available and to ship the Artwork to you.
If we do not hear from the Artist within those 4 days we will return the funds to you within 7 days of having received your payment and consider the transaction void.
The Artist is responsible for packaging the Artwork securely and dispatching it to you by a tracked delivery service within 4 days.
You will be notified when the Artwork is dispatched.
When you receive the Artwork, it is advisable to inspect it immediately. If it is
- Not what you were expecting
- Not as described
then please, photograph the Artwork (especially highlighting any damage) and contact us at Sales@MeMyArt.com. It is advisable to keep the packaging in case it needs to be returned.
You may return the Artwork free of charge within 14 days of receipt, but it must not have been exhibited, copied or photographed for commercial purposes. Just contact us at Sales@MeMyArt.com to discuss the return and you will be refunded within 14 days after the Artwork is safely received by the Artist.
You acknowledge that the Contract for your purchase of any Artwork is with the Artist and that MeMyArt is simply acting as an agent on the Artist’s behalf. We would strongly recommend that you read our Terms of Service both of which are incorporated into the Contract between you and MeMyArt.
Terms for the Artist
By listing your Artwork for sale on MeMyArt you are agreeing to the terms set out below and to our Terms of Service both of which are incorporated into the Contract between you and MeMyArt.
When you put work for sale on MeMyArt, it is essential that you will be in a position to fulfil your obligations to the buyer and to MeMyArt. If you have any questions please contact us at Sales@MeMyArt.com especially prior to listing your Artwork for sale.
The information provided when listing your Artwork for sale forms part of the terms and conditions of the contract and the Buyer will be relying upon the information you provide when buying your Artwork. All fields in blue must be completed in order to sell Artwork on MeMyArt.
If you receive an enquiry from a potential buyer, you must respond to it within 2 days. All messages between you and any potential buyers will be directed through and monitored by MeMyArt. We retain the right to reply to and from messages, in which case our response will be visible to both the Buyer and Seller in the message centre.
When you are notified that your Artwork has been sold you must inform us immediately if the Artwork is no longer available by clicking on the relevant box in the ...... page. This will cancel the transaction and will allow us to inform and issue a refund to the Buyer.
If it is still available, but you are unable to dispatch it within 4 days or if it is no longer presented as described on the site, you must inform us at Sales@MeMyArt.com and we will negotiate with the buyer on your behalf to determine if the change is acceptable.
It is your responsibility to ensure that your Artwork is properly packaged and protected from the rigors of transport from you to the Buyer.
Flat Artwork (paper, card, board etc) should be covered with non acidic paper and either rolled and placed in stout tube or shielded with a minimum of thick card so that it cannot be accidentally bent.
Please pay particular attention to the corners of your Artwork which should not be directly touching the corners of the outer packaging.
You must dispatch the Artwork directly to the Buyer within 4 days of being notified that the Buyer has placed an order for your Artwork and you must provide Shipping details. The initial cost of this is down to you, but you will get it back when the Buyer accepts the Artwork. If the artwork is returned we will cover the cost of the return only.
We will need the name of the Shipping Agent/Provider and a Tracking Number. We will be unable to arbitrate on your behalf if you do not provide a Tracking Number, in such events you will be liable for any loss incurred.
You will receive payment within thirty days of the Buyer receiving the Artwork unless we hear from the Buyer that they wish to return the Artwork or that it is damaged or not as described.
The Buyer has the right to notify us if they are unhappy with Artwork within 14 days of receipt. If a refund is required then the Buyer will return the Artwork directly to you. The refund will be issued 14 days from you receiving the Artwork unless you contact us, however MeMyArt Ltd reserves the right to refund the buyer under any circumstances.
You acknowledge that the contract for the sale of your Artwork is between you and the Buyer and you authorise MeMyArt to negotiate and enter into that contract in your name and on your behalf.
You warrant that you are over 16 years of age and able to enter into a contract in your own name.
